society and the definition of the state of law are too theoretical and declarative. As we
know, the main function of law is the regulation of social relations, if this function is
not performed, then a state that can only exist stably within the limits of law is always
in the system of a deep crisis of state administration.
Formation of civil society and the realization of human and civil rights and
freedoms are possible only in the legal field, which operates in the system of public
administration. Also, it is necessary to translate a number of general principles of the
rule of law into the level of specific legal rights and responsibilities, and the society
itself must achieve a very high level of material and spiritual development, wealth [1,
p.647-660].
All this means that social phenomena such as civil society and the state are not
antagonistic. They anticipate and need each other. Without a legal state it is impossible
to have a civil society, without a civil society a full-fledged state of law is impossible,
where the legal reality of the protection of human and civil rights and freedoms can
exist. It is the state of democracy in modern society that largely determines the
existence of a system of self-governing communities unconnected with the state, while
the legal possibilities of their activity and existence by the state are established. The
society, which is formed on the basis of respect for human rights and freedoms, is able
to withstand state restrictions and state arbitrariness, to seek the best possible
implementation of civil administration.
CONCLUSION
Thus, in order to democratize society and state it is necessary to engage not only
in legislative, political and legal activities, but also in promoting the development of
civil society on the foundation of the legal culture of statehood. To promote the
structuring of the community, the awareness of people about the value of their interests,
the valuation of their own and other's rights, dignity and freedom, the dissemination of
legal knowledge and the full recognition and implementation of the rules and
procedures of socio-political interaction.
At the present stage for civil society development the necessary condition is to
overcome the system of bureaucratic command and administrative authority, to
implement the principle of separation of powers and to provide a mechanism for
monitoring society through the activities of state and political persons of general and
self-government public administration.
