composition of the system as well as the upper system components’ priority of actions
and the right to intrude to lower levels and the dependence of upper levels acts on the
functions performance of lower levels.
The hierarchical system adjustment is often connected (A.V. Shcherbakova, H.S.
Fedorova (2011)) with the process of changes in its structure with the prime aim to
increase its functioning productivity [34].
Main results. For deeper understanding of the issue we’ll list some legal acts of
Ukraine which regulate the sphere of information and cyber security: Constitution of
Ukraine [18], Laws of Ukraine “On Bases of Cybersecurity Provision of Ukraine” [47],
“On National Security” [46], “On Information” [45], “On Information Protection in
Telecommunication Systems” [49], Decision of the Cabinet of Ministers of Ukraine
“On the Approvement of the Concept of the Digital Economy and Society
Development of Ukraine and Approvement of the List of Activities aimed at its
Fulfilment” [32] to mention a few. We cannot but mention the Orders of the President
of Ukraine, provisions of the Penal Code of Ukraine [21] and Code on Administrative
Delinquencies of Ukraine [16], some regulations and decisions of the Cabinet of
Ministers of Ukraine, decisions of the Council of National Security and Defense of
Ukraine. Therefore, the Doctrine of National Security of Ukraine is of strategic
importance [39].
Apropos the practical step in information security legal provision was launching
of the Computer Emergency Response Team as a part of State Service of Special
Communications and Information Protection of Ukraine (the CIP). Besides the Article
5 of the Law of Ukraine “On Bases of Cybersecurity Provision of Ukraine” [47]
provides the list of information security provision subjects within their competences
ranging from the Council of National Security and Defense and its subdivision –
“National Coordination Cybersecurity Center”, state authorities and municipal bodies
(e.g. Ministry of Defense, Ministry of Finance, Ministry of Justice, Ministry of
Internal Affairs, Ministry of International Affairs, Head Quarters of Armed Forces of
Ukraine), legal entities and natural persons, engaged in providing licensed services
related to national information resources, e-services, e-transactions, e-
communications, information protection and cyber security [47; Art. 5].
International legal acts ratified by the Supreme Council of Ukraine form a
separate group of legislation. To begin with, it is the Convention of the Council of
Europe on Cybercrime (2001) [19]; International Convention for the Suppression of
the Financing of Terrorism (1999) [24]; Convention on Laundering, Search, Seizure
and Confiscation of the Proceeds from Crime: Council of Europe (1990) [20];
Resolution of General Assembly of UNO “Elements of creation of global culture of
cybersecurity” (2002) [7] etc.
