limited only to presenting relevant data that show or allow to draw conclusions as to
whether discrimination was possible or actually took place.
Thus, having considered the main provisions of the current labour laws regarding
their compliance with fundamental labour principlees defined by the ILO Declaration
on Fundamental Principles and Rights at Work and its Follow-up (1998), it can be
stated that there is a need for its improvement taking into account the international
labour standards requirements.
CONCLUSION
A positive aspect of the national labour legislation development is the introduction
in the draft Labour Code of Ukraine of regulations aimed at implementing the
fundamental principles at work, their definition and specification, including the
principles of non-discrimination in employment and forced or compulsory labour.
However, the provisions on the prohibition of the worst forms of child labour and also
on the freedom of association and real recognition of the right to collective bargaining
as fundamental principles at work were not properly developed in the draft Code, which
must be considered without fail in further work on improving the national labour
legislation.
The outlined concept on improving the national labour legislation under the
influence of international labour standards, highlighted development prospects and
proposed amendments will allow to increase the national labour law development
efficiency and bring it considerably closer to the international labour standards level.
However, it should be remembered that the adoption of the new Labour Code of
Ukraine can not by any means indicate achieving the desired result, since there is a
further need to develop provisions for implementation of the set quality standards, and
it should certainly not become a cause for the termination of relevant research in the
science of labour law.
