HISTORIOGRAPHY OF RESEARCH OF SUPERVISION AND CONTROL
OVER OBSERVANCE OF LABOUR LEGISLATION IN UKRAINE (END OF
XIX – BEGINNING OF XXI CENTURY)
Introduction. Supervision and control over the observance of labour legislation
as an complex interdisciplinary institute takes its origins from the beginning of the
formation of factory legislation in the second half of the ХІХ century. The research of
the theoretical and historical aspects of its formation and development on the territory
of Ukraine during about a half-century period was of interest to many scholars, first of
all, law historians, labour law researchers and administrative law researchers, who used
various methodological approaches. In addition, the clarification of trends and
peculiarities of the formation of the supervisory and control institution over the
observance of labour legislation in terms of its inclusion in the "general context of
historical and legal reality" [1, p. 64] needs the involvement of a wide range of sources
and diverse scientific literature in the theory of law and state, the history of state and
law of Ukraine, the history of trade union movement and labour policy in the scientific
circulation. Therefore, the analysis of the historiographical part of the topic of the
research involves the classification of sources by subject and chronological criteria.
According to the subject criterion there are three main blocks: 1) research on the
legal nature of supervision and control by specialists in administrative law; 2) the
research of the theory of labour law in general and the place of the institution of
supervision and control over the observance of labour legislation in its system, in
particular; 3) papers on the history of state and law, which the separate stages of the
formation and development of labour law of Ukraine are analyzed, including the
periods of presence of Ukrainian lands into the territory of other states with their
existing legal systems and taking into account the influence on the formation of
national law of world trends and international standards.
In addition, it should be noted that there are no complex modern studies of
historical and legal models of supervision and control over the observance of labour
legislation in Ukraine. Therefore, the purpose of the paper is to carry out an analysis of
the historiographical sources with the help of the chronological criterion, according to
which traditionally it can be distinguished: 1) the historiography of the imperial period;
2) Soviet historiography; 3) modern historiography; 4) foreign historiography. Each of
the blocks will be considered in the light of the subject criterion.
