a more efficient model of social dialogue.
It is also worth highlighting
that the experience of developed countries suggests
that a high culture of safety at work is beneficial for employees, employers and the
state. Various preventive measures have proven effective in preventing accidents at
workplaces and in improving productivity. Modern high standards of safety in some
countries are a direct consequence of long-term policies that encourage tripartite social
dialogue, the conclusion of collective agreements and agreements between the parties
to the social dialogue in the field of labour.
Ukrainian legislation should include a provision stating that the employees have
the same individual and collective labour rights as other categories of employees,
including personal non-property labour rights.
This is especially true that, for instance, part-time employees must receive the
same treatment as full-time permanent staff. Specifically, it is important to ensure that
temporary employees and other categories of employees, who are involved in non-
standard forms of employment, enjoy equality and non-discrimination in terms of
wages, social benefits, training, and access to collective bargaining.
It is important to bear in mind that l
aws, policies, institutional mechanisms, co-
operation with civil society and adequate funding are all necessary tools on the road to
achieving real equality between full-time employees and other categories of
employees.
Broadly speaking, the issue of human rights has gained worldwide importance,
and the world of work is especially felt her exacerbation, increasing the importance of
state forms of protection of labour rights.
The critical importance of ensuring the labour right by courts of general
jurisdiction, supervisory authorities, the Ukrainian Parliament Commissioner for
Human Rights.
Judicial protection is the most effective forms of protection of rights and
freedoms. Dispute prevention and resolution is today attracting more and more
attention, as the effective prevention and resolution of labour disputes is critical for
sound and productive employment relations.
In exercising control functions, the State Labour Service of Ukraine emphasized
the formation of partnerships with business, defining as a priority direction of
explanatory work, providing consultations. On the other hand, the State Labour Service
of Ukraine holds a principled position on violators of the law, defending the interests
of the employee in the safe and healthy working conditions, timely and full payment
of wages and social guarantees.
Labour inspectors play an important role in the prevention of disputes on labour
rights issues. They must take timely measures to ensure that: a) employees and
