employers are informed about the content of laws and by-laws; b) employees and
employers received advice on what they need to do in order to properly comply with
relevant laws and by-laws; c) the laws and by-laws were enforced, and in the event
that, despite the information provided and consultations, the law was not respected,
sanctions were applied.
An important role,
for instance, in the field employment protection belongs to the
institution of the Ombudsman (the Ukrainian Parliament Commissioner for Human
Rights), which is characterized by democratic features such as independence from
public authorities, the openness, the lack of formalised procedures for consideration of
appeals, the free provision of assistance to citizens.
The Ukrainian Parliament Commissioner for Human
Rights as equality body
occupy a unique position. They (equality bodies) are statutory bodies. They are not part
of civil society and they do not represent any particular set of interests in society. They
are independent statutory bodies. They are not part of Government. Equality bodies
play a unique role as independent statutory bodies. They are the cornerstone institutions
for the implementation of equal treatment legislation with their mandate to combat
discrimination and to promote equality.
Thus, jurisdictional form of protection of labour rights is the activity of statutory
bodies (courts, bodies for review of labour disputes, bodies for supervision and
monitoring compliance with labour legislation, ombudsmen) to protect violated or
challenged rights and interests. The essence of this form is that persons whose rights
and legitimate interests are violated by unlawful actions apply for protection to the state
or other competent body which is authorised to take the necessary measures to restore
the violated right, to suppress the violation and to compensate for the damage.
Finally, it is important to acknowledge that one of the fundamental task of labour
legislation should be the protection of individual and collective, property and personal
non-property labour rights.
